Agreement
The Smart Loan Amortization Calculator (the “Site”) is operated by Pond Consulting. “Pond Consulting,” “we,” and “us” mean Pond Consulting. “You” means the person using the Site.
By using the Site, including by calculating a schedule or downloading an Excel, CSV, or PDF file, you agree to these Terms and Conditions and to the Privacy Policy. If you do not agree, do not use the Site.
The Site is free
You may use the calculator without paying Pond Consulting and without creating an account. Pond Consulting does not promise that the Site will always be available. We may change, suspend, or withdraw any part of it at any time, without notice and without liability to you.
What the Site is
The Site applies a standard amortization calculation to the figures you enter and can export the resulting schedule. That is all it does.
The Site does not make, arrange, negotiate, or service loans. Pond Consulting is not your lender, broker, or financial institution. The Site does not provide financial, investment, tax, accounting, or legal advice. Using it does not create an advisory, fiduciary, or professional relationship with Pond Consulting.
No endorsement
Pond Consulting does not endorse, recommend, approve, reject, or disapprove any number, schedule, comparison, conclusion, or decision that arises from use of the Site. A result is the output of the calculation and the figures you supplied. It is not a statement of opinion by Pond Consulting, and it is not an offer, a quote from a lender, or a commitment by anyone.
Results and exported files
A schedule on the screen, and the same schedule in an Excel, CSV, or PDF file, can differ from a statement you receive from a lender or loan servicer. Rounding, fees, insurance, taxes, a variable or promotional rate, the payment due date, and the way an extra payment is applied can all change the figures.
You alone decide whether to rely on a result. You must check it, including every exported file, before you act on it, share it, or give it to anyone else. Pond Consulting does not keep a copy of an exported file after it is sent to your browser and is not responsible for what happens to that file on your device or after you send it onward.
Your responsibilities
- You will not enter another person’s identifying information.
- You will not use the Site to mislead anyone or for an unlawful purpose.
- You will not attempt to disrupt, overload, or gain unauthorized access to the Site.
- You are responsible for the decisions you make after reading a result or an exported file.
Disclaimer of warranties
The Site, the calculations, the on-screen results, and the exported files are provided “as is” and “as available.” To the fullest extent permitted by law, Pond Consulting disclaims all warranties, whether express, implied, or statutory, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose, title, and non-infringement. Pond Consulting does not warrant that the Site will be uninterrupted or error-free, or that any result will match a lender’s figures or be suitable for your loan.
Limitation of liability
To the fullest extent permitted by law, you cannot hold Pond Consulting, or its owners, employees, or contractors, liable for any issue, loss, or damage arising out of or related to your use of the Site, your inability to use the Site, any calculation, any on-screen result, or any data the Site provides, including exported files. This includes direct, indirect, incidental, special, consequential, exemplary, and punitive damages, and any loss of money, interest, a loan, a business opportunity, or data, whether the claim is in contract, negligence, or any other theory, even if Pond Consulting has been told that such damage is possible.
Because you use the Site for free, Pond Consulting’s total liability for any claim arising out of the Site will not exceed the amount you paid Pond Consulting for that use, which is zero United States dollars (US $0), except where the law does not allow that limit.
Some places do not allow certain exclusions or limits. In those places, the exclusions apply only as far as the law allows. Nothing in these terms excludes liability for fraud, or any other liability that cannot legally be excluded.
Indemnity
You will defend and hold harmless Pond Consulting and its owners, employees, and contractors from claims, damages, losses, and reasonable attorneys’ fees arising out of your use of the Site, an exported file you generate, information you submit, or your breach of these terms, except to the extent the claim is caused by Pond Consulting’s fraud or willful misconduct.
Intellectual property
The Site, its design, and its text belong to Pond Consulting or its licensors. You receive a personal, non-exclusive, non-transferable, revocable permission to use the Site for your own calculations. You may not copy the Site, resell access to it, or present it as your own product. You may keep and use an export you generate for your own records.
Privacy
Our Privacy Policy explains that we do not collect personally identifiable information and that we do not store the figures you enter. It is part of these terms.
Changes
We may update these terms by posting a new version on this page and changing the effective date. If you keep using the Site after that date, you accept the updated terms. If you do not accept them, stop using the Site.
General
These terms, together with the Privacy Policy, are the entire agreement between you and Pond Consulting about the Site. If a court holds part of them unenforceable, the rest stays in effect. A failure by Pond Consulting to enforce a term is not a waiver. You may not assign these terms. Pond Consulting may assign them. Headings are for convenience only.
These terms are governed by the laws of the place where Pond Consulting has its principal place of business, without regard to conflict-of-law rules. The courts of that place have exclusive jurisdiction, except that a non-waivable consumer protection law may allow you to sue in the courts of your home, and except that Pond Consulting may seek injunctive relief in any court of competent jurisdiction.
